Allahabad HC declares UP Madarsa Education Act, 2004 unconstitutional, cites violation of secular principles

Luck now: In a significant ruling, the Allahabad High Court on Friday declared the Uttar Pradesh Board of Madarsa Education Act, 2004, as “unconstitutional” and in violation of the principle of secularism.

The Lucknow bench of the Allahabad High Court, while deeming the law ultra vires, directed the state government to integrate current madarsa students into the formal schooling system.

The verdict was delivered by a division bench comprising Justice Vivek Chaudhary and Justice Subhash Vidyarthi in response to a writ petition filed by Anshuman Singh Rathore.

Furthermore, the bench emphasized that the state government must ensure that children aged between 6 to 14 years are not left without admission in duly recognized educational institutions.

Anshuman Singh Rathore’s petition challenged the constitutionality of the UP Madarsa Board and raised objections to the management of madarsas by the Minority Welfare Department, both at the Union of India and state government levels.
