SC dismisses anticipatory bail plea of POCSO accused Rehana Fathima in semi-nude video case

New Delhi: The Supreme Court on Friday dismissed the petition filed by activist and POCSO accused Rehna Fathima, in a case pertaining to a video that she released in June of her minor children painting on her semi-nude body.

The top court bench led by Justice Arun Mishra said, ” Why do you do all this? You might be an activist (but) what kind of nonsense is this? It is obscenity you are spreading. It will leave a very bad taste in society”.
“What impression will growing children get from this act?” Justice Mishra asked.

On July 24, the Kerala HC had dismissed her plea paving the way for her arrest in the case. Fathima has been booked under sections 13, 14, and 15 of the POCSO Act, section 67B(d) of the Information Technology (IT) Act, and section 75 of the Juvenile Justice Act at the Ernakulam Town police station based on a complaint filed by a local BJP leader.

Senior advocate Ranjith Marar appeared in court for Rehana Fathima. The state government also opposed the granting of anticipatory bail in the Supreme Court.

The police had registered a case against her after BJP OBC Morcha state secretary AV Arun Prakash filed a complaint in the Pathanamthitta court. Rehana had approached the apex court days after the high court denied her bail. However, the police in the meantime did not took action against her.
