Lucknow: The Allahabad High Court has ruled that a man is obligated to pay alimony to his wife, even if he is unemployed. The court emphasized that even in wage work, one can earn 300-400 rupees. Dismissing the plea filed by a young man against the family court’s order to pay Rs 2,000 per month as alimony to his divorced wife, the court held its decision.
According to the case details, the couple got married in 2015, and following dowry demands, the woman filed a complaint against her husband and mother-in-law. Subsequently, she returned to her parents’ home. The husband appealed to the High Court, citing the wife’s graduation and monthly earnings of Rs 10,000 as a teacher. He mentioned his own illness and residence in a rented room, asserting the responsibility for caring for his parents and sisters.
The High Court observed that the man failed to produce any evidence to support his claim about his wife’s income as a teacher. It also rejected the argument that the man’s parents and sisters were financially dependent on him, emphasizing the man’s ability to earn through hard work. Referring to a 2022 Supreme Court order, the court asserted that even if the man claims no income from work, he remains liable to pay maintenance to his wife. The court noted that even an unskilled worker can earn a minimum of Rs 300 to Rs 400 per day.
