ERNAKULAM: It has been reported that today, the Kerala High Court quashed proceedings against a man who was accused under the Protection of Children Against Sexual Offences (POCSO) Act. The court canceled the case after it was revealed that the victim had been married to the accused with her permission.
The High Court order states, ‘They are now living together as husband and wife. Therefore, there is no useful purpose served by continuing with the prosecution against the petitioner.
Earlier, the petitioner filed the complaint at the court, that the accused have sexually assaulted at her age of 17 (minor), while she was studying in 12th standard, by kidnapping her from her school in his car and assaulted.
Later, after the girl become major, the both got married.
In this situation, while the case is before the court, the counsel for the petitioner pointed out that the petitioner (the accused) and the victim got married in June 2023 and are now living together as husband and wife.
Therefore, the court considered it a suitable case within its jurisdiction to quash the proceedings against the petitioner, as continuing them would serve no useful purpose, and thus, the court quashed the proceedings.
