Idukki: A plea seeking re-investigation in Vandiperiyar case has been moved before the Kerala High Court by the mother of the victim. The writ petition by the mother of the five and a half-year-old minor girl who was sexually assaulted and murdered in Vandiperiyar, Idukki, has been filed demanding that high-ranking officials investigate the case under the supervision of the High Court. The new petition comes while the appeal filed by the child’s father and the criminal appeal filed by the government are pending before the division bench.
A local Court had acquitted the accused Arjun in the Vandiperiyar case citing improper investigation and lack of evidence.
The plea moved by the mother of the stated that even though it was found that the child was subjected to sexual assault, it was due to the faulty investigation that the Trial Court had to acquit the sole accused for insufficient evidence.
In the writ petition, the child’s mother alleged that investigating agencies tried to save the culprit. The police came to collect evidence three days after the incident related to the case happened and the accused was produced in the court after seven days. It is also stated in the petition that the DNA test of the accused was not conducted.
The plea stated that the deceased minor girl belonged to a marginalized community in the society and her family deserve a fair trial and investigation into the death of their daughter as guaranteed by the Constitution of India.
