New York: It is reported that 24-year-old Daniel Penny will be charged with manslaughter for the chokehold death of Jordan Neely on a New York subway train. Penny is expected to surrender on Friday. If found guilty, Penny could face up to 15 years in prison.
The incident happened on May 1 inside a subway train. Daniel Penny, a US Marine Corps veteran choked and killed 30-year-old Jordan Penny, a homeless man. According to witnesses, Penny was yelling at and harassing the passengers on the train before he was subdued by Neely and others. Penny was questioned by police and released without being charged.
The Medical Examiner’s office ruled Neely’s death a homicide.
The struggle on the train was captured in a four-minute video showing Penny choking Neely and holding on for an additional 50 seconds after he stopped struggling. The video was circulated online and it set off protests in US demanding justice for Neely and seeking Penny’s immediate arrest.
In the days after the video went viral, many politicians and activists said that Penny would have been kept in custody if he had been black.
