New Delhi: In a major verdict, the Supreme Court on Tuesday ruled in favour of Female Property Rights owing to the amended Hindu Succession Act.
Supreme Court said that daughters will have the right over parental property even if the coparcener had died prior to the coming into force of the Hindu Succession (Amendment) Act, 2005.
The three judge bench held that rights under the amendment are applicable to living daughters of living coparceners as on August 9, 2005, irrespective of when such daughters are born.
Justice Arun Mishra pronounced the judgement after a batch of appeals raised the issue whether the Hindu Succession (Amendment) Act, 2005, which gave equal right to daughters in ancestral property, has a retrospective effect.
