New Delhi: Supreme Court has accepted the broad rules put forward by the Enforcement Directorate. Court accepted their conditions on bail and the power to arrest and investigate.
The court ordered the ED to retain powers to investigate, seize assets and make arrests in cases of black money. The important verdict was issued by a bench comprising Justice AM Khanwilkar, Justice Dinesh Maheshwari and Justice CT Ravikumar.
The court order clarified that the ECIR submitted by the ED would stand parallel to the FIR filed by the police and the details and it is not mandatory to provide the information to the accused and it should only be provided at the time of the arrest.
The court verdict was on petitions challenging the ED’s arrest and confiscation of property under the Prevention of Money Laundering Act. The judgment is a result of the 242 petitions filed by the accused in black money cases, including Karthi Chidambaram, former Maharashtra minister and NCP leader Anil Deshmukh. These petitions were challenging the provisions giving wide powers to the ED.
