New Delhi: As a reply to the complaint filed by the KSRTC in the Supreme Court, the Indian Oil Corporation (IOC) said that they cannot sell diesel to KSRTC similar to the rate charging from the small scale consumers.

It is unconstitutional and the complaint should be dismissed with heavy charges as penalty, clarified IOC in an affidavit filed in Supreme Court.

IOC filed the affidavit on a complaint filed by KSRTC in which they demanded to provide diesel similar to the rate of the market price.

KSRTC is a bulk customer, their concessions are already provided and it is unconstitutional to give them relaxation according to the variation in the market price, says IOC in the affidavit.

As of now, the KSRTC has to pay 139.97 crore rupees and among that, 123.36 crore rupees are diesel charges alone and 16.61 rupees has to pay as interest.  Determination of the price does not come under the discretion of the court and diesel is being supplied to KSRTC on the basis of an agreement, IOC clarifies in the affidavit.
