Kochi: HC cancelled Saritha’s petition that demanded the secret statement of Swapna Suresh, the accused in the ongoing Kerala gold smuggling case.
Saritha had asked for a copy of the Swapna’s secret statement recorded under 164 against CM Pinarayi Vijayan and his family. The Court cancelled her petition and said that the secret statement is not a public record. The High Court had already criticized the petition while considering the case.
What right Saritha has to ask for a copy of Swapna Suresh’s confidential statement? asked the court.
The court also asked how a person who has nothing to do with the case can ask for a confidential statement.
Meanwhile, the ED is all prepared to submit Swapna’s secret statement before the court. If the court permits, they will submit the statement in a sealed cover.
