Kozhikode: Senior Congress leader and Supreme Court lawyer, Kapil Sibal, said that no State in India can refrain from implementing the Citizenship Amendment Act (CAA), which is passed by the Parliament. His statement comes after Kerala and Punjab passed resolutions against the Act.
He said that denying the implementation of the Act would be unconstitutional. He was speaking at the Kerala Literature Festival when he made this statement.
Kapil Sibal said, “If the CAA is passed no state can say ‘I will not implement it’. It is not possible and is unconstitutional. You can oppose it, you can pass a resolution in the Assembly and ask the central government to withdraw it.”
He added, “But constitutionally saying that I won’t implement it is going to be problematic and going to create more difficulties.”
The Punjab Assembly followed Kerala and passed a resolution against CAA. The Punjab government also said that it would approach the Supreme Court challenging the Act. However, political experts believe that the resolution by a State Assembly has no bearing against an Act passed by the Parliament of India.
