Kerala High Court grants bail to accused who made abusive and casteist remarks against Minister K Radhakrishnan on Facebook

Ernakulam: The Kerala High Court has approved bail for an individual held in judicial custody over alleged abusive and caste-related remarks made on Facebook against K Radhakrishnan, the Minister for Welfare of Scheduled Castes, Scheduled Tribes, and Backward Classes.

The charges against the accused fall under Section 153A of the IPC and Section 3 of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act. The complainant asserted that the accused posted a defamatory comment on a Facebook post featuring the minister’s photograph, using abusive language related to the minister’s caste.

In the court proceedings, the defence contended that the accused had no intention to defame the minister or create enmity between different groups based on caste or community. The accused expressed that the Facebook post was shared by mistake and publicly apologized for the incident.

The court took note that the accused voluntarily surrendered to the investigating officer, was subsequently arrested, and presented before the court. A report confirming the petitioner’s remand in judicial custody was also submitted. Convinced that the investigation was nearing completion and further detention was unnecessary, the court granted bail to the accused.
