Kochi: The court will today consider the plea filed by Saritha S Nair, the prime accused in the solar panel scam, seeking the copies of 164 statement of Swapna Suresh, the main accused in the diplomatic baggage gold smuggling case. Amicus curiae, assigned to enquire on the legality whether 164 is a public document, had submitted its report last week.
The report states that the 164 cannot be considered as public document until the enquiry is completed and the charge sheet is submitted before the court. The report also stresses that the copies of 164 statement should not be released and the right to inspect the secret statement completely lies in the investigating agency.
Saritha Nair, in her sanction petition submitted before the Principal District and Sessions Court of Ernakulam, expressed that some allegations may have been brought on record against her.
