Ernakulam: The Top Court has sent notice to Kerala and Assam in the petition filed by Ameerul Islam, the accused in Jisha murder case. The Supreme Court’s action is on the plea to shift the prison from Kerala to Assam. The Supreme Court directed that the reply be given within four weeks.
He approached the Supreme Court with a demand to transfer him from Kerala to Assam jail. The petition states that his wife and parents are in Assam and are in poverty. As per the current law, the accused cannot be shifted to another jail as he is sentenced to death, announced the bench comprising Justice Maheshwari.
Subsequently, the Supreme Court had directed to question the 2014 rules issued by the Kerala government in the petition if the prison change is necessary. This is clarified in the petition heard today. The demand was to transfer from Viyyur Jail to Assam Jail. It was raised in the petition that seeing family members is a fundamental right. It was on this petition that notices were issued to Kerala and Assam and is suggested to reply within four weeks.
