Kochi: The High Court says that the strike of the Government employees is illegal. HC said that the people who are conducting the strike have no right to claim salary and must take strict action against them. The division bench also said that the Government must take their own stand in this. The order was issued by the bench headed by Justice S. Manikumar.
A strike is illegal under Rule 86 of the Service Rules. The court alleged that the salary of the people who takes part in strike, is to encourage the strike.
It is not right to give payments to the strikers from the government’s account. A division bench comprising Chief Justice S. Manikumar and Justice Shaji P Chali said the payment of salary is something equal to encouraging the strike.
The court’s observation was while considering a public interest litigation filed by Chandrachudan Nair, a native of Trivandrum, seeking to declare the 48-hour strike called by the joint trade union as illegal, last year. Earlier, the court had criticized the payment of salaries to the strikers. The court asked the government to take necessary steps in this regard.
