New Delhi: The Supreme Court on Wednesday stated that most divorces arise from love marriages. Supreme Court’s two-judge bench BR Gavai and Sanjay Karol made such an observation while hearing a transfer petition arising out of a matrimonial dispute.
The counsel informed the court that the marriage was a love marriage. According to Bar & bench, Justice Gavai said, “Most divorces are arising from love marriages only”.
The Bench finally called for mediation between the couple.
Recently, a five-judge Constitution bench headed by Justice SK Kaul said that the Supreme Court can dissolve a marriage on the grounds of ‘irretrievable breakdown’. The Court said that in order to grant divorce several factors should be considered including the time the couple lived together after marriage, their issue and the allegations raised against each other. The Supreme Court stated that it grant divorce using special power even if one of the parties oppose.
