THIRUVANANTHAPURAM: In response to the upcoming seminar on the Uniform Civil Code (UCC) organized by the CPI (M) on Sunday, Samastha has expressed concern and emphasized the need to review the CPM’s past actions in the Assembly. Within Samastha, there is strong disagreement regarding the CPI (M) seminar against the UCC.
Samastha has raised questions about the CPI (M)’s previous stance during the Shariat agitation and their current opposition to the UCC. They highlighted instances where E. K. Nayanar, as the Leader of the Opposition, and T.K. Hamza of the LDF confronted the Muslim League in the House. It is well-known that when the Supreme Court ruled on the Shah Bano case on April 23, 1985, affirming the right of divorced Muslim women to receive maintenance from their husbands, EMS welcomed the decision.
During that time, EK Nayanar and MV Raghavan urged TK Hamza to strongly criticize the Muslim League and clarify the CPI (M)’s stance on the Uniform Civil Code and their disapproval of Sharia laws. TK Hamza argued that Sharia law and Indian law are distinct, advocating for the need for a unified legal system and silencing the League leaders in the House. However, the same CPI (M) is now opposing the UCC and organizing seminars while inviting both Samastha and the Muslim League, which raises concerns about their political motives.
The Sunni Mahal Federation (SMF), a feeder organization of the Samastha Kerala Jem-Iyyathul Ulama, has exposed the fundamental contradictions in the CPI (M)’s positions. In a press release, the SMF firmly stated that there is no room for altering the Muslim Personal Law. They emphasized that by examining the CPI (M)’s history, their inconsistent double standards become evident.
The SMF’s position has confirmed that they do not support the CPI (M)’s gender equality policy and disagree with any attempts to change the personal laws of Muslim believers.
While Sharia mandates that men bear all expenses for women and the family, demonstrating Islam’s consideration for women, it also stipulates that half of what the man receives from the property should be given to the woman. This contradicts Sharia law. The CPI (M)’s occasional support for gender equality reveals their inconsistency in this regard.
Meanwhile, CPI (M) State Secretary Govindan addressed reporters and stressed the Party’s support for Personal Law reforms. The SMF condemns Govindan’s statement.
A joint statement was issued by U Shafi Haji, the SMF state general secretary, Abdul Samad Pookkottur, Nasar Faizy Koodathai, and Hamza Rahmani, highlighting their concerns.
