Ernakulam: The Consumer Disputes Redressal Commission said that 24 hours stay at hospital to claim insurance claim is a violation of consumer rights. The Commission pointed out that as there are modern medical treatment systems available there is no need to stay 24 hours in a hospital and therefore denying the insurance claim is a violation of the consumer’s right.
The order by the Commission comes on a complaint filed by John Martin, who is a native of Marad in Ernakulam. According to his complaint, his mother had a surgery on her left eye, which was performed at a private hospital in Ernakulam. As the surgery was done using modern technology, his mother did not require any hospital stay for recovery. She was discharged on the very day itself.
However, when they approached the insurance company to claim the amount of the surgery, the company denied their request. The insurance company said that John Martin’s mother was not admitted to the hospital for 24 hours and that the surgery can be only considered as an Out Patient treatment.
Following the insurance company’s denial, the policy holder approached the District Consumer Disputes Redressal Commission and earned a favorable order.
