Kozhikode: Harshina, a native of Kozhikode, is set to approach the High Court seeking compensation after a pair of scissors were found stuck in her stomach during a surgery at the Government Medical College in 2017. The Harshina Samara Samiti has decided to demand Rs. one crore in compensation for the incident. The police will file a charge sheet within the next two days to initiate legal proceedings against the doctors and nurses who were involved in the surgery. Harshina had protested in front of the secretariat, expressing dissatisfaction with the government’s lack of action. With this, the government granted permission to prosecute the medical personnel responsible for the malpractice.
The charges against the accused medical professionals are under IPC 338, pertaining to grievous hurt caused by reckless or negligent acts endangering human life. If convicted, the offenders could face a jail term of up to two years.
The medical team, including Dr. CK Rameshan, Dr. M Shahna, and nurses M Rahana and KG Manju, are expected to face legal consequences for their negligence. The incident occurred in 2017 during Harshina’s third delivery operation. The medical team failed to notice the scissors left inside her stomach. Harshina continued to experience severe abdominal pain post-surgery. The scissors were discovered inside her stomach during a scan and were removed through surgery. Harshina expressed that permission to prosecute the medical professionals was obtained after a prolonged legal battle. She asserts that the legal fight will continue until adequate compensation is received for the physical and emotional trauma she faced.
