Thiruvananthapuram: The first case under the HIV and AIDS (Prevention and Control) Act, 2017, has been registered in the state. Acting on the instructions of S. Shamnad, the Sub-Judge and Secretary of the Thiruvananthapuram District Legal Services Authority (TDLSA), the museum police have filed a case against three individuals.
This marks the first instance of a case being registered in the state since the Act’s enforcement in 2017. The complaint was brought to the Legal Services Authority with the assistance of J Sandhya, an activist and former member of the Kerala State Commission for Protection of Child Rights.
Under the HIV and AIDS Act, all actions violating the human rights of individuals living with HIV are subject to punishment. The accused individuals allegedly disclosed the complainant’s HIV-positive status to family and friends as a means of humiliation during a family dispute.
The case has been registered under Sections 4 and 37 of the HIV and AIDS (Prevention and Control) Act. These sections entail a penalty of imprisonment for up to two years and a fine of one lakh rupees.
